USA based location based services provider, TruePosition says that itsconspiracy lawsuit against Ericsson, Alcatel-Lucent and Qualcomm will moveforward.Judge Robert Kelly, Sr., of the United States District Court for the EasternDistrict of Pennsylvania, ruled in a decision issued on August 21, 2012, thatthe "allegations of an illegal conspiracy between the Corporate Defendantsare plausible when viewed in context and as a whole."TruePosition's lawsuit alleges that the three companies are conspiringagainst it in the field of location based services.The lawsuit alleges the three companies "hijacked" the StandardSetting Organizations (SSOs) that govern which mobile positioning technologieswill be in the standard for future LTE networks. The complaint accuses thedefendants of blocking the adoption of TruePosition's technologies, while at thesame time ensuring that their own technologies were included in the newstandards.Also named in the complaint is the standard setting organization itself:Third Generation Partnership Project (3GPP).Stuart Salen, Senior Vice President and General Counsel of TruePosition,stated: "We are pleased with the court's careful study of the allegationsand well-reasoned decision, and look forward to proving our case."The case, TruePosition Inc. v. LM Ericsson Telephone Company, et. al., No.11-4574 (U.S. District Court, Eastern District of Pennsylvania), was originallyfiled in July, 2011. Judge Kelly dismissed that version of the complaint inJanuary 2012, but invited TruePosition to refile with more specific allegationsof an antitrust conspiracy. The Amended Complaint was filed in February, 2012.
